Terms & Conditions
These Terms govern every quotation, booking, and engagement between you (the "Client") and Mpishire Hospitality ("Mpishire", "we", "us"). By accepting a quotation or paying any deposit you confirm that you have read, understood, and agreed to these Terms.

1. Acceptance of these Terms
Acceptance of a Mpishire quotation, signature of a booking confirmation, or payment of any deposit, balance, or full amount constitutes binding acceptance of these Terms together with the specifics of the quotation. Where a separate written agreement is signed, that agreement and these Terms shall be read together; in the event of conflict the signed agreement prevails.
2. Quotations & Pricing
All prices are quoted in Kenya Shillings (KES) and remain valid until the "valid until" date on the quotation. After that date pricing may be re-issued based on prevailing food, fuel, supplier, and operational costs. Taxes are charged where applicable. Unless explicitly stated, quotations exclude venue hire, statutory permits, security, accommodation for staff travelling outside Nairobi metro, and any third-party fees.
3. Bookings & Confirmation
An event date is only reserved once the agreed deposit has been received and a booking confirmation has been issued by Mpishire. Until then, dates remain available on a first-come, first-served basis regardless of verbal or written indications of intent.
4. Payments — Strictly Non-Refundable
All payments (deposit, balance, or full) are strictly non-refundable once made. Acceptance of a quotation and payment confirms booking of the event date and the allocation of supplier, staff, and operational capacity to your event.
Unless otherwise agreed in writing: a deposit of 50% is payable to confirm the booking; the balance is payable no later than 7 days before the event. Accepted payment methods include M-Pesa, bank transfer, card, and cash receipted at Mpishire's offices.
5. Changes, Add-ons & the 7-Day Deadline
Final guest count and all event requirements — including but not limited to menu selections, venue details, tents, décor, equipment, furniture, event timing, and any other booked services — must be confirmed no later than 7 days before the event date.
Any approved changes may incur additional charges and are subject to product availability, staffing requirements, supplier availability, and operational capacity. Requests submitted less than 7 days before the event may be declined at Mpishire's sole discretion. Reductions in guest count or scope after the 7-day deadline do not reduce the agreed amount payable.
7. Client Responsibilities
The Client shall provide accurate event information, ensure timely payments, secure venue access and permits, disclose dietary restrictions and allergens in advance, and behave (and ensure guests behave) lawfully and respectfully toward Mpishire staff and suppliers.
8. Venue, Access & Utilities
The Client warrants that the venue is fit for the planned event and that adequate power, water, lighting, parking, loading access, and waste disposal are available at no cost to Mpishire. Any generators, additional power, or extended access required will be quoted separately.
9. Food Safety, Allergens & Leftovers
Mpishire prepares food in line with applicable food-safety standards. Once food has been served or left the controlled temperature window, leftovers are consumed at the Client's and guests' own risk. Mpishire is not liable for food taken off-site or consumed after the contracted service window. Clients must disclose serious allergies in writing at least 7 days before the event.
10. Alcohol & Licensing
Where alcohol is supplied or served by Mpishire, the Client confirms the venue holds the necessary licences. Mpishire reserves the right to refuse service to intoxicated guests or minors and to terminate service without refund where safety is compromised.
11. Staff Conduct & Safety
The Client shall ensure a safe working environment for Mpishire staff. Harassment, abuse, or unsafe conditions entitle Mpishire to withdraw staff without refund. Overtime beyond the contracted hours is chargeable at the prevailing hourly rate per staff member, billed in 30-minute blocks.
12. Equipment, Décor & Damages
All hired equipment, linen, glassware, furniture, and décor remain the property of Mpishire or its suppliers. Loss, breakage, or damage during the event (other than fair wear and tear) will be invoiced at replacement cost and is payable within 7 days.
13. Photography & Marketing
Mpishire may photograph food, table settings, and event ambience for portfolio and marketing purposes. We will avoid identifiable images of guests where reasonably possible. Clients who wish to opt out must notify us in writing at least 48 hours before the event.
14. Cancellation & Postponement
Cancellations by the Client do not entitle the Client to any refund of amounts paid (see Section 4). Postponement requests will be considered on a case-by-case basis subject to availability and supplier/staffing commitments already incurred; any difference in cost for the new date is payable by the Client. Mpishire reserves the right to cancel and refund where required by law, force majeure, or a serious breach by the Client.
15. Force Majeure
Mpishire shall not be liable for failure or delay caused by events beyond reasonable control, including but not limited to natural disasters, civil unrest, government action, pandemics, strikes, or failures of public utilities or major suppliers. In such cases the parties will work in good faith to reschedule.
16. Limitation of Liability
To the maximum extent permitted by law, Mpishire's total aggregate liability arising out of or in connection with a booking shall not exceed the amounts actually paid by the Client for that booking. Mpishire shall not be liable for indirect, incidental, or consequential losses.
17. Indemnity
The Client agrees to indemnify and hold Mpishire harmless against any claims, losses, or expenses arising from the Client's or guests' acts or omissions, breach of these Terms, or misuse of services supplied.
18. Intellectual Property
All menus, recipes, designs, proposals, photographs, branding, and written materials produced by Mpishire remain the intellectual property of Mpishire and may not be reproduced or shared with third parties for competitive purposes without written consent.
19. Data Protection & Privacy
Personal data is processed in line with the Kenya Data Protection Act, 2019, and our Privacy Policy. We collect only the information necessary to deliver and improve our services.
20. Disputes & Governing Law
These Terms are governed by the laws of the Republic of Kenya. The parties shall attempt to resolve any dispute amicably within 30 days; failing which the dispute shall be referred to a single arbitrator appointed under the Nairobi Centre for International Arbitration rules. The courts of Kenya shall have exclusive jurisdiction over any matter not subject to arbitration.
